Terms of Use

1. Acceptance of Terms
By accessing Well Tracker (“Well”), you confirm that you are at least 13 years old and agree to comply with these Terms. The operator is Volodymyr Dudchak, Private Entrepreneur.
2. Description of the App
Well Tracker monitors personal health metrics through Apple Health integration and manual check-ins, providing insights based on user-provided data.
3. Account Registration
Users must provide accurate information and keep their credentials secure. The operator reserves the right to suspend or terminate accounts that violate these Terms.
4. Permitted Use
You may only use the app for personal, non-commercial wellness tracking. Prohibited activities include reverse engineering, copying, distributing, unauthorized access attempts, using automated systems, transmitting malware, and interfering with functionality.
5. Health Disclaimer
Well Tracker is not a medical device and does not provide medical advice, diagnosis, or treatment. You should consult qualified healthcare providers for medical concerns rather than relying on the app.
6. Apple Health (HealthKit) Integration
The app reads authorized health data. You acknowledge that data accuracy depends on device sensors and Apple Health sources. You may revoke access through device Settings.
7. Third-Party Services and AI-Powered Analysis
The app uses Amplitude for anonymized analytics, Sentry for technical diagnostics, and AI services (OpenAI, Anthropic) for pattern analysis. All data transmitted to these services is fully anonymized, and health data is not shared with Amplitude or Sentry.
8. Intellectual Property
App content and materials are owned or licensed by Volodymyr Dudchak. You retain ownership of the personal data and check-ins you submit.
9. User Content
You retain ownership of your content. By submitting content, you grant a limited license for service provision and improvement purposes.
10. Privacy
Use of the app is governed by a separate Privacy Policy describing our data collection and protection practices.
11. Availability and Updates
We do not guarantee uninterrupted operation. The operator may modify, suspend, or discontinue the app at any time. You are responsible for keeping the app updated.
12. Limitation of Liability
The app is provided “as is” and “as available” without warranties of any kind. Liability is limited to amounts paid in the preceding 12 months.
13. Indemnification
You agree to indemnify the operator against claims arising from your use of the app or violations of these Terms.
14. Termination
You may delete your account at any time. The operator may terminate access for Terms violations or other reasons.
15. Governing Law and Dispute Resolution
These Terms are governed by Ukrainian law. Disputes proceed through negotiation first, then through the competent Ukrainian courts.
16. Changes to These Terms
Updated Terms are posted within the app with revised dates. Continued use constitutes acceptance.
17. Severability
Invalid provisions do not affect the enforceability of the remaining Terms.
18. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement.
